(en) Italy, FDCA: AGAINST 41 BIS AND THE REPRESSIVE REGIME (ca, de, it, pt, tr)[machine translation]

Date Sun, 29 Jan 2023 09:01:22 +0200

Always used as a form of deterrence against crime and dissent, over the years the prison has assumed an exclusively punitive function. The state no longer even prides itself on providing the fig leaf of the offender's rehabilitation, limiting itself to cutting funding for facilities, shrugging the shoulders at the degraded situations inside the prisons and ultimately forgetting those who are there detainees, leaving room for a limbo of permanent suspension of the law which few are scandalized by. ---- The data leaves no way out: at the end of 2022, over 80 people took their own lives in a prison; since 2000 there have been 3,500 deaths in prison, of which 1,240 by suicide. In prisons people commit suicide 16 times more than outside.

Prison does not re-educate, prison kills.

This dramatic situation is associated with that of the 759 people subjected to the restrictive regime of 41bis, one of whom is the anarchist Alfredo Cospito, who is carrying out a hunger strike to the bitter end for the abolition of this juridical monstrosity.

Cospito seriously risks life imprisonment with a special surveillance regime and prohibition of communication with the outside world as he planted a low-potential bomb outside a school of carabinieri students: the very heavy accusation was that of massacre against the security of the state, although there is no trace of a massacre as the bomb limited itself to blackening a couple of walls. But the state knows how to crack down on those who go against it.

Cospito, like the other inmates under 41bis, is essentially in permanent isolation, with no contact with the outside world, locked up in a cubicle for 22 hours a day, with two hours of contact with 3 other inmates under 41bis, without the possibility of reading, to study, to correspond with the outside world, with his and her companions, with his family, with the prohibition of listening to music or watching TV, without even being able to keep photos of loved ones with him. A real death sentence diluted over time, to which Cospito opposes with the only means left at his disposal: his own body.

The harsh repression to which it was subjected rips the veil of hypocrisy of a weak state, which embellishes itself by defining itself democratic, fair, just while pursuing direct actions that call it into question, because the state is ruthless with those who question it .

In our society dominated by capital, profit and exploitation, the resulting function and purpose of justice can only be class-oriented, that is, aimed at defending and perpetrating the current capitalist regime, even when it comes to combating its very contradictions from from which they originate, who coexist with it and who, like the mafia and organized crime (against which the 41bis regime was conceived), are an integral part of the state and its institutions.

But no crime can be fought with inhuman means, which moreover, having legal legitimacy, can also be used to fight social struggles as has always happened.

Further proof of this is the recent question of the youngest generation, and in particular of Simone, for whom, after a non-violent action of civil disobedience, special surveillance was requested. An answer as decomposed as it is exaggerated, which testifies once again how the king is naked, that whoever exposes the king to public ridicule, putting him in front of his own faults and shortcomings, as in the case of the climate issue, for which rivers of words, hundreds of agreements signed, dozens of conferences organized on the subject without a single iota being changed, without ever questioning the capitalist system itself. Young people and climate activists are precisely reminding those who govern us of all this and also in this case the answer has come with repression.

As anarchist communists we resolutely reject the cruel bourgeois logic that "the end justifies the means", instead claiming the congruity of means/ends (the means employed determine the legitimacy and achievability of the end) as an historical heritage of anarchism, for a free and equal society that sees the exploitation of living beings and the nature that surrounds us banned.
