In March and May of this year, the ZSP Association ended the dispute with the operations of the Zabka network in Warsaw and Lódži. In the Warsaw branch, the boss hired a worker without a contract, and then did not want to pay her the full salary. In Lódži, on the other hand, they did not want to pay the full amount of their wages. ZSP proceeded as we do in similar cases. ZSP and the employee went to the store on Sunday, May 30, where the owner of the operation was to be present. Instead, there was a worker who said the owner was on vacation. ZSP left in place a letter requesting and explaining the consequences that would result in non-payment of the amount due. The response was quick and shortly afterwards the worker received money owed.

Warsaw - first there was no contract, then remuneration for work

At the Warsaw plant, the head of Zabka demonstrated a practice that is common in Poland. A person does not receive an employment contract before the beginning of the employment relationship or immediately after starting, but only after its termination, or on the day of payment. The payout is then often significantly lower than originally agreed. In order to insure their bosses and claim that the amount of the salary is in order, they do not keep records of working hours and claim, for example, that the workers have not worked so many hours, or come up with various deductions from the salary.

In the case of the Zabka store on ul. Nowak-Jezioranski's chief did the following:

She did not provide an employment contract before the start of the employment relationship. The employee received only one document (entitled "contract"), even after the termination of her employment.

ZSP and the robbed worker came to the Zabka store. They had a letter with them requesting payment of the outstanding remuneration. In the store, they met the mother of the boss, who openly said that there was nothing wrong with not paying the full amount if the employer did not like the way the employee worked. Nor was it hindered that taxes were not paid, there were no working hours, etc. When the boss appeared, she repeated similar statements. For example: "We don't have to prove how much time she worked. That must be proved by the employee. "

ZSP's reaction was clear: "We informed the owner that she was breaking the law and that it was the employer's duty to keep proper records of working hours. We have also announced that we will return and hold a protest picket. "

Immediate success and more plans

ZSP continues: "When we were at the bus stop, the boss called that he still wanted to pay the salary he owed. The worker was satisfied, which is not surprising, because many people cannot afford to be robbed of their paycheck. However, the problem remained. It is known that the tax office and ZUS (social insurance company) receive nothing and illegal employment is disadvantageous for employees and society. We also assume that this situation will be repeated. And because the owner wants to open another store, she can become another place of illegal employment, which also poses a risk for other workers. "

ZSP is in contact with workers from other Zabka stores. They plan to push the company to introduce a point in its franchise agreements that is currently missing there - to ensure that legal employment is a condition of running a business.
