The PL inserts in the Indian Statute the Temporal Framework thesis, which recognizes the right to land only of peoples who occupied the territory until the promulgation of the Constitution, ignoring the continuous displacement and expulsion processes that the peoples suffered indigenous peoples over these 521 years of colonization. It also allows the implementation of hydroelectric power plants, mining, roads and leases, among other actions in territories occupied by indigenous peoples, eliminating free prior and informed consultation to affected communities.
In theory, it enables the suppression of indigenous rights guaranteed in the Constitution, such as permanent possession of their lands and exclusive rights over their natural resources, opening the way for the exploitation of indigenous lands by agribusiness and mining. It makes it easier for the government to take "Reserved" Indigenous Lands if it deems that the territory is not being occupied and properly used for the subsistence of its residents. The "Indigenous Reserve" is a type of TI established to ensure the physical and cultural survival of an indigenous people, but where traditional occupation was not necessarily recognized, according to current anthropological technical knowledge. This is because a large part of these areas were made official based on the 1973 Indian Statute. Many areas purchased or donated to indigenous peoples could also be taken: today, nearly 70,000 indigenous people live in 66 areas, in an area of around 440,000 hectares of land.
