The verdict is a scandal - Jan, the defendant who was sentenced to imprisonment, was not even there that evening at Jamnitzer Platz. ---- The rejection of the appeal in the Jamnitz trial by the Munich Higher Regional Court is part of the will-to-persecution type of litigation against Jan. This means that all legal means to take action against the scandalous judgment have been exhausted. The prison sentence of 1 year and 2 months is final and Jan has to go to jail for over a year. For allegedly yelling at police officers. But he had nothing to do with what happened that evening - he wasn't there.

This judgment not only has drastic consequences for him. It opens up a new dimension in the arbitrary prosecution and criminalization of anyone who is a thorn in the side of the police. It can form the basis for further judgments of this kind.
The investigations and litigation in the first instance already showed that the judiciary is keen to see Jan behind bars. In the event of an acquittal, the public prosecutor's office would be forced to review inconclusive and contradicting statements made by the police officers. But this did not happen in the appeal - the instance in which the evidence is to be critically examined again.

Everything that a single policewoman said against Jan was found to be true, while exonerating statements were called false statements. As a result, the higher regional court did not want to find any procedural deficiencies in the appeal. Instead, it refused, with obvious reluctance to actually review the verdict.

The process is a new escalation of the longstanding conflicts around Jamnitzer Platz. The dispute is an expression of the intensifying processes of gentrification, displacement and displacement in the Nuremberg district of Gostenhof for years.

Behind the conflict over the space is the contradiction between the interests of the mainly wage-dependent tenants who use the space and the interests of property owners and the city of Nuremberg. Owners are trying to pacify the square in order to make the area more attractive for further investments.

Now an example has been made to two people, which is supposed to deter. The city and the police want to regain the authority to interpret the Jamnitzer with all their might.

Even if the rejection of the appeal and the prospect of more than 1 year in jail for nothing are pretty bleak, we are not intimidated by such judgments. They join the nationwide criminalization of and repression against anti-fascist structures.

Solidarity was, is and remains our strongest tool in the fight against persecution and arbitrariness. We will therefore organize a rally when Jan arrives and see him off together. So keep checking all channels in this regard.
