(en) Poland Posnan, rozbrat: THE JUDICIARY CONTINUES TO DISREGARD THE HARM DONE TO TENANTS -- Stanislaw Krastowicz

Date Sat, 17 Oct 2020 11:19:32 +0300

Just a few days ago, the media informed that the house cleaner Piotr Sruba, convicted by a final sentence, would not be sent to prison, at least for now. For the next year after his imprisonment, he will be saved by allegedly poor health. Even if the premises for postponing the enforceability of the penalty on this account are generally understandable, it is also obvious how we approach this "health" of a tenement cleaner with great skepticism. The sluggish actions of the police, the prosecutor's office, and later the court, gave the tenement house cleaner and his principals a lot of time to prepare both for the case and for all possible scenarios. Apparently, the judiciary wants to remind you once again that it can successfully prosecute and punish only the weak and the poor - people without connections and contacts.

There is no need to mention it too much - throughout the entire stage of the tenement movement's struggle with the cleaning of tenement houses, the situation was clear. Despite the notorious threats, intimidation and harassment on the part of Piotr Sruba and his helpers, tenants of Poznan tenement houses have repeatedly faced obstruction by the called police patrols. There was no desire to accept reports, and when the police showed up, they simply washed their hands. This was partly due to the ignorance of the tenancy law, but also the usual laziness, the bullying of the officers, and even worse, some forms of cooperation with Piotr Sruba himself. It was thanks to the actions of the tenants themselves, who publicized the problem and got the media interested in it, that it turned out that these were the officers who informed Piotr Sruba about the actions of the tenants. It took place at the stage of loud protests of the tenement house at Stolarska Street. Let us remind you that at that time, thanks to the actions of a lawyer representing tenants, a tenement house cleaner had a court ban from approaching the tenement house itself within a distance of 100 meters. People wrote and talked about the illegal activities of Screw, the use of alleged renovations to make life difficult for tenants, threats and harassment directed at them. Despite this, there were policemen who passed on information to the cleaner - to what extent they helped him and how close the cooperation was, we will never know exactly, because the prosecutor's office did not know how to or did not want to reliably deal with this topic during the investigation against the cleaner of the houses. The same police and prosecutor's office were able to prosecute, interrogate and punish activists and tenants' activists. However, in the case of the principals of Piotr Sruba himself, little has been done or even nothing has been done. What about the fact that the connections of certain daughter companies with NeoBank were clearly articulated, and what about the fact that during the ongoing trial these threads were served to the prosecutor's office even on a tray. There was no determination, and apparent will, to prosecute those who financed the entire process of cleaning tenement houses and benefited from it.

Fortunately, at least some of the tenants were determined. It was thanks to their activities that the Wielkopolska Association of Tenants was established, and thanks to their efforts, it was possible to win at least financial compensation for the harassment they experienced. But is this a sufficient form of justice? Is it a complete form of righting wrong? There are doubts here. Publicizing the cleaning of tenement houses certainly broke the infamous career of Piotr Sruba. This career, however, has never been particularly successful. Bolt was simply brazen in his methods - obviously overconfident and not very careful, he never expected someone to oppose him, which in part worked. It is enough to look at how long the police and the prosecutor's office did not react to his actions. However, the impunity of its principals and the profit that can be derived from the activities on the real estate market, where the constant lack of a sufficient number of apartments pushes up prices, causes the practice to continue - only the form changes. There is still intimidation and harassment against tenants, we are still witnessing illegal evictions, and the successors of Bolt are simply trying to be more sophisticated and do not want to be so obvious.

Unfortunately, the apathy of the judiciary, which takes such a disrespectful approach to harm to tenants, becomes an incentive to continue this type of action. Impunity creates an atmosphere of consent. Lengthy proceedings allow time to prepare, cover up traces and, as a last resort, probably also to ensure that "health prevents serving a sentence", at least on paper. This situation is shameful but it must not break us down in the fight against injustice. Again, we must, even louder, demand the punishment of the perpetrators and principals who have made money by harming tenants.

People who benefited financially at a time when others had to fear "thugs" like Piotr Screw and his companions, their bandit methods - worms tossed into mailboxes, firecrackers fired in tenement houses, night noises, threats of arson - must be punished . There can be no reduced fare from this penalty - the tenement house cleaner did not pay attention to the age or health condition of the people he harassed. And if it did, it was only to use it to hit the weaker people.

Therefore, we will continue to shout loudly - enough of breaking tenants' rights! Enough of disregarding their wrongs. No reduced fare for Piotr Sruba and his principals!
