HUMAN RIGHTS? --- I´m puzzled and perplexed by the discussion in the community and
the fourth estate that claims the treatment of Cornelia Rau by the Queensland
government and the Federal government has stripped Ms Rau of her human rights. Human
rights? Discussion about human right in Australia is both pointless and futile
as Australians do not, as many think they do, enjoy inalienable human rights.
Australian citizens, resident and asylum seekers only enjoy the rights that
are given to them by parliament. Over the past two decades, a raft of
legislation has been passed through Federal parliament by both the Liberal /
National Party and the Australian Labor Party, that has legally stripped
illegal immigrants of any rights they may have held.

Every challenge to parliament´s power to strip away rights people may enjoy,
who don´t have the necessary documentation to immigrate to Australia
including parliament´s right to detain children and adults indefinitely
behind razor wire, deny children who are born in Australia whose parents are
illegal immigrants, Australian citizenship and forcibly deport illegal
immigrants, although they may face imprisonment and execution, have been
constitutionally upheld by a series of High Court decisions over the past
two decades.

Australian citizens and residents fare little better, there is precious
little in the Australian Constitution concerning inalienable human rights.
The Constitution is essentially a document that regulates the relationship
between the Federal government and the States; it has little if anything to
say about human rights. The power to confer and strip away rights rests
solely in the hands of parliament. Legislation that´s been passed in the
past five years through Federal parliament allows the State to legally
detain and secretly interrogate any citizen or resident because that person
may inadvertently have gained information that may assist secret agencies
with their inquires.

The only human rights that Australians enjoy are the rights conferred on
them by parliament. Parliament giveth and parliament taketh. That is why a
government that enjoys a majority in both Houses of Federal parliament is
such a dangerous proposition.

WORKPLACE CHANGE,
KEY TO THE ECONOMY?
Never let the truth get in the way of a good scare campaign seems to be the
Coalition´s ongoing strategy. Remember those images of electors casting
their ballot vote for the Howard government, believing the government´s
propaganda that a vote for Howard would be a vote for low interest rates?
Well it seems those pesky unions are all that now stands between low and
high interest rates.

Costello, the Federal Treasurer, thunders that ´workplace change is the key
to the economy´. In plain, very plain English, Costello´s proposition is
that while workers have the power to collectively bargain, interest rates
will rise. He claims that unions and workers struggles to retain conditions
and maintain wages, will create inflationary conditions that will lead to
high interest rates. Sounds plausible, doesn´t it?

Maybe plausible to the government gelded ABC and the corporate owned media,
but implausible to anyone with one synapsing neurone. The problem is not
unions, wages or conditions; the problem is a shortage of skilled labour.
Employers are falling over themselves, offering packages to skilled labour
to come and work for them. The single most important effect of the Black
Plague in Europe during the Middle Ages was the shortage of labour that
occurred as a result of the number of deaths that occurred due to the
plague.

Serfs found that if they banded together and negotiated with the Lord of the
Manor, they were able to win a better deal for themselves, as a result of
that shortage of labour. The Howard government finds itself in a crisis of
its own making. For far too long, it has allowed conditions to develop that
have allowed employers to get away with not training apprentices. Australia
now finds itself in a situation where it faces a critical shortage of
skilled workers as a result of the Howard government´s policies towards
training Australian workers.

Faced with this problem, the Howard government is trying to deflect
criticism by blaming the unions for high interest rates and inflation, not
its economic policies. It has put mechanisms in place that will allow
employers to flood the country with cheap foreign contract workers and it is
working behind the scenes to decrease its pathetically small refugee intake
and dramatically increase migration rates, hoping to solve the problem of
inflation and high interest rates by flooding the country with cheap labour.

Industrial relations, health, education, the list goes on and on. The
constitutional agreements that exist between the Federal and State
governments are at a critical crossroads. The Howard government is on a
mission to stamp its authority on the States, overturning constitutional
arrangements that have stood the test of time. The Education Minister waxes
lyrical about a national Grade 12 examination, Howard blusters on about the
need for national Industrial Relations laws, Ruddock mumbles about national
defamination laws.

Areas that have traditionally been State responsibilities are being usurped
by a Federal government, which has appointed enough High Court judges to
know that it stands a very good chance of winning any High Court challenges,
which are mounted by the States against the Federal government´s attempts to
concentrate power in its hands. The battle isn´t some academic slanging
match that has no bearing on people´s day to day lives. It´s an important
battle that if lost, could radically remove protections that Australians
have traditionally enjoyed as a consequence of the power sharing
arrangements that exist between the States and the Federal government.

Traditionally, Australians have relied on the States protecting them against
Federal government excesses when one political party has enjoyed a majority
in both Houses of parliament. The Howard government, acutely aware that its
legislative agenda may be frustrated by the States, has launched a broadside
against the States, hoping that with the assistance of a sympathetic High
Court, they will be able to exercise absolute power and sideline the States.

The predicament facing Australians is a critical one. If the current
constitutional arrangements are overturned, the resultant concentration of
power in the hands of the Federal parliament will give the national
government of the day the chance to unilaterally implement its political
agenda, irrespective of the human and social costs that legislative agenda
causes.

COMEDY OF ERRORS
The reaction to the incarceration of Cornelia Rau, a mentally ill Australian
in the isolation unit of the Baxter Detention Centre, is amusing,
perplexing, disturbing and tragic. It´s amusing to see the Immigration
Minister Amanda Vanstone and immigration officials trying to justify their
incarceration of Rau in the Brisbane Correctional Centre and the Baxter
Detention Centre, claiming she didn´t have a psychiatric disturbance, while
the spokesperson of the centre she was admitted to when their mistake was
discovered, states she was admitted to an intensive care high dependent unit
because of her psychiatric condition.

It´s perplexing to understand how the Queensland police and the Immigration
department didn´t even bother to cross-check her identity with missing
person´s records around Australia, especially when the German Consul claimed
she was not a German citizen. The comedy of errors surrounding her
detention could be the plot for a new Kafka novel.

It´s disturbing to think that someone with such a florid psychiatric
disorder could be treated in such a cavalier manner for such a long time.
It´s incomprehensible to think that it was the detainees at Baxter who
raised the alarm about Ms Rau´s condition and that refugee advocates were
forced to take up her case.

It´s extraordinary to think that the Queensland Police force, the Australian
Immigration department, the Australian Federal Police and all the
contractors involved in her incarceration didn´t raise the alarm. The only
people who took her situation seriously were the Aboriginal people from Coen
who were so concerned about her condition, they took her to the Cairns
police station and the refugees locked in the Baxter Detention Centre who
were so concerned about the lack of care she was receiving, they raised the
alarm with refugee advocates.

It´s ironic that two of the most oppressed groups in Australian society
showed their concerns for Cornelia while the State ignored and compounded
her plight.

It´s tragic that Cornelia Rau´s nightmarish experiences while in detention,
have received so much publicity because she is an Australian citizen. Her
treatment at the hands of the Immigration authorities reflects the
degrading, disgusting, disturbing, brutal treatment that is regularly meted
out to thousands of asylum seekers in this country by a government that by
and large retains the support of a majority of Australians for the harsh and
inhumane legislation that has been pushed through Federal parliament to deal
with refugees; a problem that could and should be dealt with in a way that
reflects the minimum standards of care that Australians expect from their
government and other governments.

THE WAR THAT WON´T GO AWAY
Just in case you thought the war in Aceh has somehow gone away, think again.
Since the Boxing Day tsunami, over 200 Acehenese, mostly civilians, have
been killed in the government´s ongoing war against the separatists. The
Indonesian military has continued its brutal military campaign in the
province, although Aceh´s independence movement declared a unilateral
ceasefire when the extent of the devastation became apparent.

The Acehenese have been weathering daily assaults for over 20 years. Just
before the tsunami, 40,000 crack Indonesian troops were involved in a
counter insurgency against about 2,000 Acehenese guerrillas. Over 40,000
civilians have been killed by Indonesian forces in the province over the
past two decades. The government has used the devastation caused by the
tsunami as a cover to finish off the independence movement. It has flooded
the province with nationalist Muslim fundamentalist militia members, whose
primary role is to create organisations in Aceh that will encourage the
people of Aceh through a program of threats and aid, to abandon the Free
Aceh movement and join nationalist militia groups.

Although the Free Aceh movement is a Muslim fundamentalist group, its
primary aim is to break away from the Indonesian State and create an
autonomous State in North Sumatra that is able to, some extent like East
Timor, determine its own future.

ON ANOTHER MATTER
Did you notice how the elections held in Iraq on the 31st January were
hailed as a victory for democracy? Ten days after what was said to be a
pivotal moment in Iraq´s history´, no election results have been released.

It seems that the victors in the Iraqi elections were not the people the US
government wanted to win the elections. The Shia majority in the south
seems to have thrown in their lot with Muslim fundamentalist groups and the
Kurds in the north as expected have thrown in their lot with independence
groups that want to break away from Iraq.

The US administration faced with an election outcome it doesn´t want, is
throwing around money behind the scenes, trying to cable together a
government that is acceptable to it. That´s the problem with elections,
sometimes the people you don´t want in power, win power and you have to use
a little bit of money and military muscle to get the result you want. Like
you 10 days after the ´historic elections´, I´m still waiting for the
official result.

ANARCHIST QUESTION AND ANSWER
Q. WHAT ROLE DOES CLASS PLAY IN THE ANARCHIST STRUGGLE?
A. Class is one of those words that everybody uses but few take the trouble
to define. ´Class-division or order of society´. Anarchists talk
incessantly about class; some groups define themselves as class struggle
anarchists to differentiate themselves from anarchists who concentrate on
lifestyle or environmental issues. Many anarchists use the convoluted
Marxist definition of class, other have attempted to redefine class in terms
of power relationships.
The difference between classes has been blurred in the modern capitalist
world. Political and ideological allegiances are not necessarily linked to
income or lack of income. The ability of significant numbers of people to
move up and down the class ladder, religion, nationality and race, all play
an important role in shaping people´s consciousness. Although class
differences continue to exist, they no longer play a significant role, in
how many people view themselves.
A class analysis based on monetary income becomes less and less relevant in
such a situation. Anarchists who want to remain relevant, need to redefine
class in terms of power relationships based around the idea of order givers
and order takers. An independent contractor who doesn´t employ labour, may
be able to earn two to three times what an employee working for a
corporation may be able to earn, although they earn much more money than a
wage earner, they are as powerless as a wage earner when dealing with the
corporate world.
Everybody is both an order giver and an order taker; the exploited wage
earner may be a tyrant at home because they can exercise unlimited power in
the home situation. Class analysis based around the idea that the ruling
class is able to exercise power, while the working class is relatively
powerless, still plays a central role in anarchist struggle, a struggle that
revolves around the creation of a society where both power and wealth is
shared. Clinging to the idea that class is defined by monetary income and
that people have a common consciousness because they earn a particularly
income, is not an effective way of understanding the dynamics and class
relationships that have been created in a liberal parliamentary democracy.
Defining class in terms of power relationships that revolve around the idea
that people are both order givers and order takers is an effective way of
understanding the world. Those elements in society who through their
ownership of the means of production, distribution and exchange, their
position in government, the bureaucracy, corporations, religious
organisations or any other group in society that is able to exert power who
predominately give not take orders, are part of the ruling class, everybody
who predominately takes orders is part of the working class.

ACTION BOX
´WORDS´
´Sticks and stones may break my bones, but names will never hurt me´, wrong,
wrong, wrong!! Words shape up, define us, box us in, they can be more
powerful than bombs. ANARCHIST!!, JEW!!, POOFTER!!, MUSLIM!!, are words
that elicit a series of emotions, feelings and reactions. Other words
LIBERTY!!, FREEDOM!!, DEMOCRACY!!, have become so debased, they mean
nothing. Words are the weapons that are used in the struggle to win the
hearts and minds of those around us.
It´s important that we don´t shrug our shoulders and let our enemies define
who we are and what we believe in. To let attacks on our integrity go
through to the keeper is a recipe for both irrelevance and odium. We need
to define and redefine who we are, what we stand for and what we want. We
need to recapture those words that have become so debased they mean
everything to everyone. Democracy, liberty and freedom are not corporate
logos; they are not the exclusive property of the Bush administration. They
have a past and a future.
When faced with the misuse appropriation and fraudulent use of these words,
people need to be pulled up. When you hear some talkback jock carry on
about democracy, when you hear your neighbours talk about illegal
immigrants´, when you hear your workmates talk about bludgers, dirty Abos
and that terrorist Habib, pull them up, ask them what they´re talking
about?, where did they get their information from?, what do they mean when
they use these words? Don´t worry about whether they ignore you, shout at
you, call you a terrorist or worse, pulling them up, questioning them about
the words they are using, forces them to reassess ideas, thoughts and
feelings which they have taken as gospel. To challenge them and provide an
alternative is a revolutionary act.
We must define ourselves; we can´t let other people do it for us. We
shouldn´t let those who rule us, debase words that are central to the human
experience without challenging them. We have a choice, we can keep our
heads down, shut our mouths, do our work, consume, defecate and die or we
can reclaim our past and put our ideas, feelings, wants and aspirations as
human beings at the centre of our life experiences.
The decision about what to do ultimately lies in your hands. Use words as
your weapons, define and redefine what is important to you. Words are a
tool for radical social change that we need to reclaim and use to understand
the present and change the future.

AUSTRALIAN RADICAL HISTORY
THE EUREKA SERIES 2005-No. 5
Q. What happened to the men that were acquitted of High Treason? PART G
Michael TUOHY (1830 - 1915)
Michael Tuohy was born in Scariff County Clare, Ireland in 1830. Tuohy was
a survivor of the Irish Potato famine of 1847 and 1848. He buried many of
those who had died of starvation, when shiploads of produce were being
exported from Ireland by absentee landlords who didn´t care that the Irish
were dying of starvation in their tens of thousands. Tuohy hated the
English tyrants and came to Australia in 1849 to start a new life. When the
gold rush began, Tuohy walked from Sydney to Creswick and unsuccessfully
mined for gold. He and 40 volunteers from Creswick walked to the Eureka
stockade and camped in the stockade on the 2nd December. Tuohy was willing
to fight and die in the struggle against the same tyrannical swashbucklers´
who caused the Irish famine and who now made life of the miners on the
Victorian goldfields a misery. He escaped death on two occasions, once when
a soldier´s bayonet pierced his shirt and once when he was being marched as
a prisoner from the Eureka stockade site to the government camp, where he
was attacked by a soldier wielding a sabre. He was taken to Melbourne, held
in jail for 4 months and was acquitted of the charge of High Treason on the
23rd March 1855. After his acquittal, he returned to the diggings, when the
gold ran out, he started farming at Ballan and continued farming until he
died on the 10th September 1915. Michael Tuohy attended the 50th
anniversary celebrations in Ballarat in 1904. In 1908 his claim that the
State government reimburse him for his legal costs for the 1855 trial were
rejected. He was the last of the 13 men tried for High Treason to die. He
is buried in an unmarked grave in the Ballan cemetery (grave No.308) next to
his wife Mary (grave No.307).

James BEATTIE (1823-1901)
Born in Cumberland, England in 1823, the son of Lieutenant James Beattie and
Elizabeth Broadbent, he arrived in Australia in early 1854 and moved
straight to the goldfields. He was arrested 100 yards from the stockade
site by the government spy Trooper Henry Goodenough. Beattie was acquitted
with Michael Tuohy of the charge of High Treason on the 23rd March 1855.
After his acquittal, he worked as a labourer at Murchison and married Mary
Harrington just after his 54th birthday on the 5th May 1877. Beattie died
at Nagambie at the age of 78 on the 30th November 1901 and was buried at the
Nagambie cemetery the following day.

BOOK REVIEW
´THE EARLY DAYS OF GREEK ANARCHISM-The Democratic Club of Patras
& Social Radicalism in Greece´
Two essays edited & translated
Paul Pomonis, Kate Sharpley Library 04, ISBN 1-873605-73-0
Anarchist Library Series ISSN 1479-9073 #6
´The Early Days of Greek Anarchism´ is another of those excellent pamphlets
that has been cobbled together by the Kate Sharpley Library. In two short
pamphlets, The Democratic Club of Patras´ and Social Radicalism in
Greece´, the history of the Greek Anarchist movement in the 2nd half of the
19th century and the early part of the 20th century, has been made available
to English readers.
In the pamphlet The Democratic Club of Patras´, the author examines the
presence of Libertarian ideas in the Greek territories from 1860 to 1880.
The article brings to life some of the main players in the emerging Greek
anarchist movement, their thoughts and actions. The pamphlet is divided
into a number of sections The Presence of Libertarian Ideas from 1860 to
1875´, From 1875-1880´, The First Revolutionary Group´, The Foundation of
the Democratic Club of Patras in 1876´, Participation in the Berne
Congress´, The Federation Democratic League of the People´, The
Publication of the newspaper Hellenic Democracy´ and ends with a section on
State Repression´.
19th century Greek anarchism did not exist in a vacuum; participants were
heavily influenced by what was going on among anarchists in the rest of
Europe. The article The Democratic Club of Patras´ was written by the:-
Libertarian Historical Archives,
P.O. Box 53, 84401, Naoussa, PAROS, GREECE.
The 2nd part of the pamphlet Social Radicalism in Greece-Reformists
Utopians-Anarchists´, analyses the role of these forces in Greece at the
end of the 19th and beginning of the 20th century. The author looks at the
role Anarcho-syndicalism, peasant anarchism, individual terrorism and
Christian-Anarchism played during this time.
Paul Pomonis has edited and translated from Greek to English two essays that
give a very good insight into the history of the early Greek anarchist
movement. This 26-page pamphlet published by the Kate Sharpley Library is
another one of those excellent pamphlets they have published that makes
forgotten and unknown anarchist history available to the English speaking
reader.

PERSONAL OBSERVATION
I´ve seen enough of John Howard to know how he operates. His modus operandi
is very, very simple. An issue breaks out that will reflect poorly on his
government, his Ministers deny any problem exists; Howard´s minders give the
Laurie Oaks of the world an opportunity to interview the main man. Howard
knows what he wants to say and he knows the Laurie Oaks of the world are
happy to give him an easy run, for the privilege of appearing ion their
show.
You can always tell when the PM is about to make the announcement that shows
his government cares, a concerned stiff look spreads across his facial
muscles, he twists towards the cameras and with sincerity pouring out of
every pore on his face, he tells the Laurie Oaks look alike and his viewers
that he understands people´s concerns about the issue and will hold an
inquiry. The Laurie Oaks look alike is happy that he´s got a scoop on his
opponents, the PM has escaped any serious questioning, the viewers are happy
that the PM cares and that something will be done to redress the problem,
end of story or is it?
The next day, the reluctant Minister sulking about the fact that the PM has
kicked them in the teeth, will make some non-descript statement about the
matter. On further questioning, the Minister blurts out, ´Yes, we are going
to hold an inquiry´, ´I´m going to pick who is holding the inquiry and I´m
also picking the terms of reference´. Game, set and match. The issue has
been buried, no worthwhile inquiry will ever be held, the Minister looks
like a fool, the PM comes out smelling of roses, the media has lost interest
and what is a potentially damaging situation has been hosed down.
Think I´m making it up, have a look at the Cornelia Rau fiasco and see what
has happened. Missed the fancy footwork this time, wait till the next
crisis and watch a pro in action. Sincerity, gravity, statesmanship, he´s
got the lot, the only thing missing, a spoonful of truth, that´s harder to
manufacture.

STOP PRESS
ONE STRIKE AND YOU´RE OUT!!
Very few prominent Australians bother to open their mouths about anything
these days. No one seems to be willing to express an opinion about
important issues. They are happy to talk about the weather, their latest
squeeze, desperate housewives, football and even the cricket, everything
else seems to be off bounds. Those that do open their mouths like Ian
Chappell and Andrew Demetriou, soon find their names have fallen off the
government´s invitation list.
Aided and abetted by a government gelded media that needs access to
government members to function successfully, those prominent Australians
that have strayed into what the Howard government considers its exclusive
domain, soon fall out of favour. The interviews stop coming, their profiles
become non-existent. Within the space of a few months, they become
non-persons, they almost cease to exist. Any further utterances that are
picked up by the media are strictly confined to their area of expertise.
Every prominent Australian knows the rules in Howard´s Australia, stick to
what you know, don´t open your mouth about what is happening around you,
dance when you´re asked to dance, smile, don´t forget to tell the fourth
estate that you live in God´s own country and you love it.
Break the rules, social isolation, scorn, derision, contempt are the rewards
you receive for opening your mouth and saying what is obvious to everyone
else. The Howard government has a habit of talking about freedom of speech,
while it uses all the means at its disposal to stop prominent Australians
from putting forward their opinions. They´re concerned if business,
religious and sporting leaders open their mouths, people may begin to
believe that things aren´t what theyre been made out to be in God´s own
country.
To date, the Howard government has been successful at stifling dissent by
Australians in leadership positions. Assisted by a relatively docile media
that needs the John Howards of the world as much as John Howard needs them,
dissent among well known Australians has been limited to a few mild
criticisms by a handful of prominent Australians who can´t live with the
current litany of lies and half-truths that they´re forced to confront on a
daily basis.

ALL THE NEWS THAT FITS
A school principal used security cameras to monitor a teacher he later
sacked, despite Govt guidelines banning closed circuit TV systems from being
used to monitor worker performance. Principal Wayne Craig used the computer
classroom footage to back his claim that teacher Gloria Ng was incompetent.
The reason given for installing the cameras was to protect computers in the
room. Mr Craig showed Mrs Ng the recording at the end of 02 then asked her
to resign. Vic Education Dept guidelines prohibit closed circuit TV systems
being used to monitor individual work performance. Mr Craig claimed staff &
students were aware they recorded 24 hours a day. He also said "no decisions
were made on a basis of that video footage" but that "it was just an eg of
the quality of her teaching." (Source: news.com.au)
An Aboriginal man who 5 witnesses say was bashed by VicPol officers may need
spinal surgery. There are also fears the incident may have triggered his 1st
attack of epilepsy & damaged his hearing. At least 5 people said they saw up
to 10 police drag 27yo Raymond William Merritt thru a smashed car window &
slam his head onto its roof while arresting him on Feb 1 last year. They
said police then pulled him to the ground & repeatedly punched & kicked him.
Merritt's mother, Lyn Young, of Leichardt in Sydney, yesterday said her son
believed he lost consciousness more than once during the arrest & had been
told he could no longer hear properly in 1 ear. "He reckons it was the worst
flogging he's ever copped in his life," Miss Young said. "He´s complained
about ringing in his ears & he´s also complained about his back & he's now
having medical attention for that up here." Miss Young said doctors at
Sydney's Prince of Wales Hospital had told her son he had to have physio &
he might need surgery to fix a dislocated disc, after he saw a medical
officer in the NSW prison system following his extradition from Vic last
July. His appearance b4 the Melb Magistrates Court last Feb had to be
adjourned at the request of his lawyer when he suffered an epileptic
seizure. Miss Young said he´d never suffered epilepsy before. Unlike several
passers-by who witnessed his arrest, Merritt never made a complaint against
police. "He said he´s too frightened of getting another hiding," Miss Young
said. She said he´s allowed to leave Vic only after he pleaded guilty to 1
charge of resisting arrest, 1 of stealing the car in which he was arrested &
1 of possessing a stolen Discman, the receipt for which she said was held by
his solicitor. "He couldn't take any more. He said to me, 'Mum, I'm just
gonna plead guilty to 1 (charge of) resist arrest & get it over & done
with'. He said: 'I can't handle it down here'." She said not even his
solicitor could talk him out of making the guilty pleas. "He just wanted it
finalised," Miss Young said. She said far from family & friends, he´d become
depressed & this had been noted by a prison psychiatrist. "It's too far for
us to come & go. I managed to get down there the once & I had planned to go
back. But he said, 'It's too far mum'," she said. As it was, he´d come to
depend on an Aboriginal worker in the prison system for phone contact with
his family in Sydney. Had he opted to contest any or all of the charges, she
said, he would have been held until Dec. (Source: The Age)
A mentally ill Aust resident was held in immigration detention for 10 months
& a mental health expert says immigration officials brushed aside his
efforts to help her. Cornelia Rau, who suffers from schitzophrenia, was
eventually discovered by her family & released into psych care in Adelaide.
SA public advocate, Jonathon Harley, said yesterday that Immigration Dept
officials were the most arrogant he´d met in his public service career,
adding they "basically ignore anything I do or say". "The way she´s been
treated would´ve exacerbated her condition," he said. It took a month for a
psych at Baxter detention centre to assess Ms Rau. (Source: Age)
QUOTE OF THE WEEK: "US officials were surprised & heartened today at the
size of turnout in Sth Vietnam's presidential election despite a Vietcong
terrorist campaign to disrupt the voting. Acc to reports from Saigon, 83% of
the 5.85 million registered voters cast their ballots yesterday. Many of
them risked reprisals threatened by the Vietcong. The size of the popular
vote & the inability of the Vietcong to destroy the election machinery were
the 2 salient facts in a preliminary assessment of the nat´l election based
on the incomplete returns reaching here." The New York Times, Sept 4, 1967.

TO MARK
THE 150TH ANNIVERSARY OF THE ACQUITTAL OF JOHN JOSEPH
The first of the 13 men charged with High Treason for his participation in
the Eureka rebellion. He was acquitted by a jury in the Victorian Supreme
Court on the 22nd February 1855. John Joseph, an Afro-American born in New
York, was chaired through the streets of Melbourne by over a quarter of
Melbourne´s population, delirious at the jury´s verdict 150 years ago today.
During the next weeks, all the other 12 miners who were charge with High
Treason were also acquitted by juries in the Victorian Supreme Court. The
collapse of the government´s case against the 13 men charged with High
Treason and their resultant acquittal, forced the government of Victoria to
introduce a raft of reforms to starve off further armed insurrection against
its authority.

MIDDAY

TUESDAY 22ND FEBRUARY 2005

Outside VICTORIAN SUPREME COURT
210 William Street, Melbourne, VICTORIA

TO PAY OUR RESPECTS
To the memory of men who have disappeared from the pages of history while
the names of their persecutors adorn the pages of this country´s history
books, its streets and place names. The contribution that these 13 men:

James BEATTIE
James CAMPBELL
Raffaelo CARBONI
Thomas DIGNUM
Timothy HAYES
John JOSEPH
John MANNING
William MOLLOY
John PHELAN
Henry REED
Jacob SORENSON
Michael TUOHY
Jan VENNIK

Made to the welfare of Victorians and Australians should be remembered, not
forgotten. It´s appropriate that 150 years after these tumultuous events, a
monument be erected outside the Victorian Supreme Court that recognizes
their significant contribution to the formation of Australia´s legal and
political institutions.

In an era when more and more decisions about an accused innocence or guilt
are being made by Magistrates and Judges, and increasing attacks are being
launched against the jury system, it´s important to remember the pivotal
role juries played in the acquittal of these men.

´THANK GOD FOR THE JURY SYSTEM´-Lionel Murphy.
